Terms of Service for Bloom Birth

Agreement to Terms

By accessing or using the Bloom Birth mobile application ("App" or "Service"), provided by Enigma ("Enigma," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING BLOOM BIRTH.

1. Acceptance of Terms

1.1 Legal Agreement

These Terms constitute a legally binding agreement between you and Enigma. By creating an account or using the App, you accept these Terms.

1.2 Age Requirement

You must be at least 13 years old to use Bloom Birth. If you are under 18, you should use the App with parent or guardian supervision.

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via the App or email. Continued use after changes constitutes acceptance.

2. Medical Disclaimer

2.1 Not Medical Advice

BLOOM BIRTH IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

  • Always seek advice from your physician, midwife, or qualified healthcare provider
  • Never disregard professional medical advice because of something you read in Bloom Birth
  • Do not delay seeking medical attention based on App content
  • In case of emergency, call emergency services immediately

2.2 No Doctor-Patient Relationship

Use of Bloom Birth does not create a doctor-patient or healthcare provider relationship.

2.3 Individual Circumstances

Every pregnancy is unique. Information in the App may not apply to your specific circumstances. Consult your healthcare provider about your individual needs.

2.4 Accuracy of Information

While we strive for accuracy, we make no warranties about the completeness, accuracy, or reliability of information provided. Medical knowledge evolves, and information may become outdated.

3. User Accounts

3.1 Account Creation

To use Bloom Birth, you must:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of unauthorized access

3.2 Account Responsibility

You are responsible for all activity under your account. You agree to:

  • Not share your account with others
  • Not create multiple accounts
  • Not impersonate others
  • Not use automated systems (bots) to access the Service

3.3 Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Provide false information
  • Engage in fraudulent activity
  • Abuse the Service or other users

You may delete your account at any time in the App through Profile → Account → Delete account, or as described at Deleting your account.

4. Subscription & Payments

4.1 Free and Premium Tiers

Bloom Birth offers:

  • Free Tier: Basic features at no cost
  • Premium Tier: Additional features via paid subscription

4.2 Subscription Plans

Bloom Birth Premium is offered as monthly and annual subscriptions. The current price, billing period, and any free trial are shown in the App and by the App Store or Google Play before you buy.

Free Trial (where offered):

  • Full access to Premium features during trial
  • Automatically converts to paid subscription unless canceled

4.3 Payment Processing

Payments are processed through in-app purchase:

  • iOS: Apple App Store (subject to Apple's Terms)
  • Android: Google Play Store (subject to Google's Terms)

We use RevenueCat to manage subscription status. We do not receive or store your payment card details.

4.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.

To cancel:

  • iOS: App Store → Subscriptions
  • Android: Play Store → Subscriptions

Deleting your account does not cancel a subscription; cancel it through the store.

4.5 Billing

  • You will be charged in your local currency
  • Prices may vary by country
  • Prices may change with 30 days notice
  • Payment is charged to your App Store/Play Store account upon confirmation

4.6 Refund Policy

General Policy: All sales are final. No refunds for partial subscription periods.

Exceptions:

  • Technical issues preventing app use (we'll investigate and may issue refund)
  • Charged in error (contact us within 48 hours)
  • Free trial charged before cancellation (contact us within 7 days)

To request refund:

  • iOS: Contact Apple Support
  • Android: Contact Google Play Support

Processing: Refund requests are reviewed within 5-7 business days.

4.7 Taxes

Prices do not include applicable taxes. You are responsible for any taxes required by your jurisdiction.

5. User Content

5.1 Your Content

You retain ownership of content you create in Bloom Birth:

  • Custom affirmations
  • Birth plans
  • Journal entries
  • Meal logs
  • Notes

5.2 License to Us

By creating content, you grant Enigma a worldwide, non-exclusive, royalty-free license to:

  • Store and display your content
  • Backup your content
  • Enable syncing across devices
  • Provide the Service to you

This license ends when you delete your content or account.

5.3 Content Standards

You agree not to create content that:

  • Is illegal, harmful, threatening, or abusive
  • Violates intellectual property rights
  • Contains personal information of others
  • Promotes violence or discrimination
  • Contains spam or advertising
  • Impersonates others

5.4 Content Removal

We reserve the right to remove content that violates these Terms or is flagged as inappropriate.

5.5 Feedback

If you provide feedback or suggestions, we may use them without compensation or attribution.

6. Intellectual Property

6.1 Our Rights

Bloom Birth and all content, features, and functionality are owned by Enigma and protected by:

  • Copyright
  • Trademark
  • Patent
  • Trade secret laws

6.2 Restrictions

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Remove copyright or proprietary notices
  • Use our trademarks without permission
  • Create derivative works
  • Scrape or mine data from the App

6.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to use Bloom Birth for personal, non-commercial use.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Bloom Birth, you also agree to our Privacy Policy.

8. Prohibited Uses

You agree NOT to:

  • Use the App for any illegal purpose
  • Violate any local, state, national, or international law
  • Infringe on intellectual property rights
  • Transmit viruses or malicious code
  • Attempt to gain unauthorized access to systems
  • Interfere with or disrupt the Service
  • Use the App to harm, harass, or stalk others
  • Collect information about other users
  • Impersonate Enigma, Bloom Birth, or our employees
  • Use the Service for commercial purposes without permission

9. Third-Party Services

9.1 Links and Integrations

Bloom Birth may contain links to third-party websites or integrate with third-party services (e.g., the Apple App Store, Google Play, and RevenueCat for purchases).

9.2 No Endorsement

Links do not imply endorsement. We are not responsible for third-party content, policies, or practices.

9.3 Third-Party Terms

Use of third-party services is subject to their terms and conditions.

10. Disclaimers

10.1 "AS IS" Service

BLOOM BIRTH IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY

10.2 No Guarantee

We do not guarantee:

  • Uninterrupted or error-free operation
  • Accuracy of content
  • Results from using the App
  • Compatibility with all devices
  • Freedom from viruses or harmful components

10.3 Use at Your Own Risk

You use Bloom Birth at your own risk. We are not liable for any harm resulting from your use.

11. Limitation of Liability

11.1 Damages Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENIGMA SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • SERVICE INTERRUPTION OR SYSTEM FAILURE
  • COST OF SUBSTITUTE SERVICES

11.2 Maximum Liability

Our total liability shall not exceed the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

11.3 Basis of Bargain

These limitations reflect the allocation of risk and are fundamental to our agreement.

12. Indemnification

You agree to defend, indemnify, and hold harmless Enigma, our affiliates, and our employees from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your content

13. Dispute Resolution

13.1 Informal Resolution

If you have a dispute, please contact us first at support@withbloombirth.com. We'll try to resolve it informally within 30 days.

13.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration, not court litigation.

13.3 Exceptions

You may bring claims in small claims court or seek injunctive relief for intellectual property violations.

13.4 Opt-Out

15. General Terms

15.1 Entire Agreement

These Terms, Privacy Policy, and any other policies constitute the entire agreement between you and Enigma.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Our failure to enforce any right or provision is not a waiver of that right.

15.4 Assignment

You may not transfer or assign these Terms. We may assign our rights to any affiliate or successor.

15.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g., natural disasters, war, pandemics).

15.6 Survival

Provisions that should survive termination (e.g., disclaimers, indemnification) will remain in effect.

16. App Store Terms

16.1 Apple App Store

If downloaded from Apple App Store:

  • These Terms are between you and Enigma, not Apple
  • Apple is not responsible for the App or support
  • Apple is a third-party beneficiary with right to enforce these Terms
  • You must comply with Apple's Terms of Service

16.2 Google Play Store

If downloaded from Google Play:

  • These Terms are between you and Enigma, not Google
  • Google is not responsible for the App or support
  • You must comply with Google Play Terms of Service

17. International Use

Bloom Birth is controlled from the United States. If accessing from other countries, you are responsible for compliance with local laws.

We make no representation that the App is appropriate or available for use outside the United States.
